confirmed or warranted in any way. We highly recommend Renters conduct their
own research regarding any and all advertising on Favorite Vacation Rentals by
Owner including, but not limited to:
- Obtain references from past renters.
- Visual inspection by requesting additional photos from the owner/manager.
- Request a copy of all advertisers policies.
- Insist on a property lease/rental agreement.
- Request a phone number to directly reach the owner/manager if one is not provided on the listing.
- Request the street address of the property rented and look it up on one
of the internet based map sites,
such as mapquest.com. - Ask the owner where else the property is advertised (established) on the Internet.
- For additional protection, check with the local Better Business Bureaus and/or Purchase Trip Insurance.
Favorite Vacation Rentals by Owner highly recommends that renters ask for and
receive, review and understand a written notice of the Refund/Cancellation
policy from the advertiser. Favorite Vacation Rentals by Owner is not
responsible for the refund of rental fees for any reason.
Renters assume all liability for use of any information found in the Favorite
Vacation Rentals by Owner Internet publication. By using or continuing to use
the services of Favorite Vacation Rentals by Owner you agree to the terms and

The management of FavoriteVacationRentals.com (vacation-rentals-byowner.com) do not assume any responsibility and do not in any way warrant the accuracy of published information..
Each property manager or owner individually writes the cancellation and refund policy. FavoriteVacationRentals.com (vacation-rentals-byowner.com) advises renters to acquire a hard copy of the cancellation and refund policy. FavoriteVacationRentals.com (vacation-rentals-byowner.com) is not responsible for any form of deposit or rent paid refunds. FavoriteVacationRentals.com (vacation-rentals-byowner.com) does not confirm, guarantee, or warrant any publicized property information. The renter is completely responsible in confirming any published information within FavoriteVacationRentals.com (vacation-rentals-byowner.com).
FavoriteVacationRentals.com (vacation-rentals-byowner.com) may experience unforeseen and controllable interruptions. FavoriteVacationRentals.com (vacation-rentals-byowner.com) and its owners are not held liable for projected service costs that are beyond those paid by the client and not delivered. Spam Policy:

Rental Inquiries:

FavoriteVacationRentals.com (vacation-rentals-byowner.com), including staff members, filter and monitor all inquiries prior to customer delivery. Although FavoriteVacationRentals.com(vacation-rentals-byowner.com) filters all inquiries, a small percent of Unsolicited Commercial Email will be delivered to the customer. Additionally, a small percent of emails not falling into the Unsolicited Commercial Email category may not be delivered. FavoriteVacationRentals.com (vacation-rentals-byowner.com) employs Internet email to deliver all rental inquiries. Therefore, these inquiries are not considered private. CONTAINED ON THIS SITE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALL
SUCH INFORMATION, SERVICES, AND MATERIALS ARE PROVIDED "AS IS" AND "AS
AVAILABLE" WITHOUT WARRANTY OF ANY KIND.
Limitation of Liability:

BUSINESS, DATA OR PROFITS, LITIGATION AND THE LIKE, WHETHER BASED ON BREACH OF
CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ACKNOWLEDGE AND AGREE THAT THE
LIMITATIONS SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THIS AGREEMENT AND THE
SITE WOULD NOT BE PROVIDED TO YOU ABSENT SUCH LIMITATIONS. SOME STATE STATUTES
MIGHT APPLY REGARDING LIMITATION OF LIABILITY.
Indemnification:

Owner, its affiliates and suppliers from any liability, loss, claim and
expense (including attorneys' reasonable fees) related to (i) your violation
of this agreement, and (ii) your posting of material to this site.
Proprietary Rights:
All materials on this site, including property information and photos, (as
well as the organization and layout of the site) are owned and copyrighted by
Favorite Vacation Rentals by Owner or its suppliers and may be accessed,
downloaded or printed for your personal non-commercial use only. Without the
prior written permission of Favorite Vacation Rentals by Owner or its
suppliers, you may not copy, distribute or transfer any material on this site,
except for property information and photos, for in whole or in part.
Changes to Site:
Favorite Vacation Rentals by Owner and its suppliers may make improvements or
changes in the information, services, products, and other materials on this
site, or terminate this site, at any time without notice. Favorite Vacation
Rentals by Owner may modify this agreement at any time, and such modifications
shall be effective immediately upon posting of the modified agreement.
Accordingly, you agree to review the agreement periodically, and your
continued access or use of this site shall be deemed your acceptance of the
modified agreement.
Miscellaneous:
This agreement and the resolution of any dispute related to this Agreement or
the site shall be governed by and construed in accordance with the laws of New
York, without giving effect to any principles of conflicts of law. Favorite
Vacation Rentals by Owner's failure to insist upon strict enforcement of any
provision of this agreement shall not be construed as a waiver of any
provision or right. Any legal action or proceeding between Favorite Vacation
Rentals by Owner and you related to this agreement shall be brought
exclusively in a federal or state court of competent jurisdiction sitting in
New York, County of Monroe and/or the Western District of New York.

Property Listings:
Owners are responsible for the accuracy of the information on their property
listings. Owners who provide photos to be used assert that the photos are
their own property and these same owners have the publishing rights to said
photos. Favorite Vacation Rentals by Owner is not responsible for any action,
or omission of action, by any renter obtained by the use of this site.
Favorite Vacation Rentals by Owner reserves the right to alter or modify
this website including but not limited to Terms of Service, geographic
coverage, offers and policies without explicit notification to subscribers or
users of this website.
Favorite Vacation Rentals by Owner is the sole arbiter of any interpretation
of content on this page. Favorite Vacation Rentals by Owner reserves the right
to reject requests for trial and paid listings and be the sole interpreter of
qualifications and criteria for each.
Membership Policies:
